What is Article 370? Special rights to Jammu and Kashmir: As all know that India's independence day in on 15 August. And this is because on this date India got independence means on 15 August 1947. On this date Jammu and Kashmir also became independent.
At that time, Raja Hari Singh was ruling as a king on Jammu Kashmir. He wants to keep his territory safe and independent. But on 20 October 1947, Pakistan-backed Kashmir Army and Pakistan Army both planned and attacked Kashmir. In this attack, they captured many areas of Kashmir. In this situation, with the consent of Sekh Abdulla, Raja Hari Singh with Jawahar Lal Nehru declared temporary merging of Jammu-Kashmir and India. And he signed "Instruments of Accession of Jammu and Kashmir to India".
In this agreement Jammu and Kashmir handed over only three subjects:

  • Defence
  • Foreign affairs
  • Telecommunication

After the signing of the agreement by Raja Hari Singh, the Government of India promised that they would provide temporary arrangements in accordance with the Constitution of India unless the people of Jammu and Kashmir would make their constitution. And with this commitment Article 370 is added to India's constitution. These provisions were implemented on 17 November 1952.

What are the provisions for Jammu and Kashmir in Article 370?

Jammu and Kashmir is a Constitutional state of Indian Union with some special rights. What are the special rights of Jammu Kashmir? These special rights are listed below:
  1. The central government cannot change the Name, Area and limits of this state without permission of state government.
  2. The central government have to take permission with the state government for making any law instead of defence, international affairs and Telecommunication.
  3. Jammu and Kashmir have their own constitution and Indian constitution can not interfere in that.
  4. Jammu and Kashmir have two flags one is their own national flag and second is Indian flag.
  5. People from other states of India are not allowed to buy any type of property in Jammu and Kashmir.
  6. Residents of Jammu and Kashmir have two kinds of citizenship, one is of Jammu and Kashmir, and second if of India.
  7. If any Kashmiri woman marries an Indian citizen, she will lose her Kashmiri citizenship.
  8. If any Kashmiri woman marries a Pakistani citizen then there will be no impact on her Kashmiri citizenship.
  9. If any Pakistani man marries a girl in Jammu and Kashmir, he will also get Indian citizenship.
  10. Normally, if any Indian citizen takes citizenship of any other country them his/her Indian citizenship ends. But in the case of Jammu and Kashmir, if any resident goes to Pakistan and then came back to Jammu and Kashmir then he will get Indian citizenship back.
  11. In Jammu and Kashmir, insult of  National symbols, National flag, national anthem, national song and etc. are not subject to punishment.
  12. Due to the article 370 centre cannot able to set any law like Financial emergency to Jammu and Kashmir.
  13. No amendment to the Constitution of India is applicable to Jammu and Kashmir unless the President makes a special order.
